These Terms & Conditions ("Terms") govern your use of the DiviKart mobile applications and website (the "Platform"), operated by [Legal Entity Name] ("DiviKart", "we", "us"). By creating an account or placing an order, you agree to these Terms. If you do not agree, please do not use the Platform.
1. About the Platform
DiviKart is a hyperlocal marketplace serving Ateli, Haryana and nearby areas. It connects customers with independent local sellers (for products such as grocery, household items, food, electronics, batteries, inverters, and solar products) and independent service professionals (such as electricians, plumbers, AC technicians, and RO technicians). DiviKart acts as an intermediary/facilitator; products are sold by, and services are performed by, the respective partners unless expressly stated otherwise.
2. Eligibility & account
- You must be at least 18 years old and capable of entering into a binding contract under Indian law.
- You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your OTPs and credentials confidential.
- We may suspend or terminate accounts involved in fraud, abuse, or violation of these Terms.
3. Orders, pricing & payment
- All orders are offers to purchase, subject to acceptance and availability with the seller/partner.
- Prices, delivery charges, and service visit charges are shown in the app before you confirm. Prices may change without notice, but confirmed orders are honoured at the confirmed price.
- Payments can be made through the payment options shown at checkout (e.g., UPI, cards, cash on delivery where available). Online payments are processed by third-party payment gateways.
- In case of obvious pricing errors, we or the seller may cancel the order with a full refund.
4. Delivery & service visits
- Estimated delivery/visit times are indicative and may vary due to weather, traffic, availability, or other factors.
- You agree to be available (or have someone available) at the address to receive the order or allow the service visit.
- For service bookings, the final quotation for repair work beyond the basic visit/inspection will be shared by the technician before the work begins.
5. Cancellations, returns & refunds
Cancellations, returns, and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms.
6. User conduct
- Do not misuse the Platform โ including placing fake orders, abusing offers, harassing partners or staff, or attempting to interfere with the Platform's operation.
- Reviews and ratings must be genuine and must not contain unlawful, defamatory, or obscene content.
7. Partner responsibilities
Sellers and service professionals on the Platform are independent third parties responsible for the quality, legality, safety, and merchantability of their products and services. DiviKart verifies partners on a best-effort basis but does not guarantee outcomes of services performed at your premises. We will, however, assist in resolving disputes in good faith through our support channels.
8. Intellectual property
The DiviKart name, logo, mascot, app design, and content are the property of [Legal Entity Name]. You may not copy, modify, or use them without our written permission.
9. Limitation of liability
To the maximum extent permitted by law, DiviKart's total liability for any claim arising out of an order or service booking shall not exceed the amount paid by you for that order or booking. DiviKart is not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law, including under the Consumer Protection Act, 2019.
10. Indemnity
You agree to indemnify DiviKart against claims arising from your breach of these Terms or misuse of the Platform.
11. Governing law & disputes
These Terms are governed by the laws of India. Subject to applicable consumer protection laws, courts at [Narnaul / Mahendragarh], Haryana shall have jurisdiction over disputes.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the app or website. Continued use after changes constitutes acceptance.
